Equality and Non-discrimination

Equality and Non-discrimination

Autor: Jane F. Adolphe , Robert L. Fastiggi , Michael A. Vacca

Número de Páginas: 198

This volume explores ways of understanding equality and non-discrimination. Drawing on the timeless logic of realist philosophy, Catholic morality, and Catholic social teaching, the authors seek to provide intellectual clarity on many controversial questions. The contributors are lawyers, philosophers, and theologians who offer rich insights into the modern crisis of social thought on equality. They examine various global assaults on human life, marriage, the family, and the natural dignity of masculinity and femininity. They seek to uphold the essential foundations of reality for the attainment of the common good. The contributors attempt to move beyond a positivist mentality in order to evaluate the first principles of the natural law in which all human law is grounded. The various chapters evaluate developments and application of theories of equality and non-discrimination in the history of Western thought; in modern European practice; in contemporary inter-American practice; in the Asian setting; in the Middle East and North Africa; and in the Catholic canon law tradition. The authors strive to restore a universally valid conception of equality and non-discrimination as...

Śambūka and the Rāmāyaṇa Tradition

Śambūka and the Rāmāyaṇa Tradition

Autor: Aaron Sherraden

Número de Páginas: 187

According to Vālmīki’s Sanskrit Rāmāyaṇa (early centuries CE), Śambūka was practicing severe acts of austerity to enter heaven. In engaging in these acts as a Śūdra, Śambūka was in violation of class- and caste-based societal norms prescribed exclusively by the ruling and religious elite. Rāma, the hero of the Rāmāyaṇa epic, is dispatched to kill Śambūka, whose transgression is said to be the cause of a young Brahmin’s death. The gods rejoice upon the Śūdra’s death and restore the life of the Brahmin. Subsequent Rāmāyaṇa poets almost instantly recognized this incident as a blemish on Rāma’s character and they began problematizing this earliest version of the story. They adjusted and updated the story to suit the expectations of their audiences. The works surveyed in this study include numerous works originating in Hindu, Jain, Dalit and non-Brahmin communities while spanning the period from Śambūka’s first appearance in the Vālmīki Rāmāyaṇa through to the present day. The book follows the Śambūka episode chronologically across its entire history—approximately two millennia—to illuminate the social, religious, legal, and artistic...

Rapt in the Name

Rapt in the Name

Autor: Ramdas Lamb

Número de Páginas: 251

In Rapt in the Name, Ramdas Lamb provides an intriguing account of the Ram bhakti tradition in India. Less well-known in the West than the tradition of devotion to Krishna, the Ram tradition is an important component of Hinduism. Ram is the most-worshipped form of the divine in North India today and has long been particularly important to those of the lower castes throughout India. Lamb explores both the evolution of the tradition and the rise of lower caste religious movements devoted to Ram, specifically the Ramnami Samaj, an Untouchable religious movement in Central India. Lamb's study of the Ramnamis has spanned nearly three decades, first on a personal level as a Hindu monk and later as both a friend and a researcher. He discusses the historical origins, as well as present-day forms and structure of the Samaj, including a description of its distinctive ritual dress and practices. Among the more innovative aspects of the sect is its adaptation of the story of Lord Ram that is uniquely woven into its devotional repetition of his name (Ramnam). In addition, Lamb shares biographical sketches of six Ramnamis, each of which reveals the freedom of individual exploration and...

Alsace to the Alsatians?

Alsace to the Alsatians?

Autor: Christopher J. Fischer

Número de Páginas: 254

The region of Alsace, located between the hereditary enemies of France and Germany, served as a trophy of war four times between 1870–1945. With each shift, French and German officials sought to win the allegiance of the local populace. In response to these pressures, Alsatians invoked regionalism—articulated as a political language, a cultural vision, and a community of identity—not only to define and defend their own interests against the nationalist claims of France and Germany, but also to push for social change, defend religious rights, and promote the status of the region within the larger national community. Alsatian regionalism however, was neither unitary nor unifying, as Alsatians themselves were divided politically, socially, and culturally. The author shows that the Janus-faced character of Alsatian regionalism points to the ambiguous role of regional identity in both fostering and inhibiting loyalty to the nation. Finally, the author uses the case of Alsace to explore the traditional designations of French civic nationalism versus German ethnic nationalism and argues for the strong similarities between the two countries’ conceptions of nationhood.

The Genetics of Osteoporosis and Metabolic Bone Disease

The Genetics of Osteoporosis and Metabolic Bone Disease

Autor: Michael J. Econs

Número de Páginas: 465

The explosive growth in the field of molecular biology over the last two decades has started to make a great impact on clinical medicine. Genes have been cloned for diseases that were poorly understood only a decade ago. Additionally, investigators are increasingly aware that there are strong genetic components to complex disorders, such as osteoporosis, that are not classically thought of as genetic disorders. New insights into the pathogenesis of metabolic bone diseases have been obtained from investigations into the molecular biology of these diseases and new therapies will become available based on these new insights. In The Genefies of Osteoporosis and Metabolie Bane Disease, I have assembled an internationally renowned group of experts to write the various chapters. Each of the authors is an expert in his/her field who is currently performing research on the content of their chapter and have made important contributions to the understanding of the clinical fea tures and pathophysiology of metabolic bone disease and genetics. The first part of The Genefies of Osteoporosis and Metabolie Bane Disease addresses issues related to genetic contributions to the development of...

Indigenous Land Rights in the Inter-American System

Indigenous Land Rights in the Inter-American System

Autor: Mariana Monteiro De Matos

Número de Páginas: 358

Rights to their traditional lands and resources are essential to the survival of indigenous peoples. They have been formulated and advanced in the most progressive way by the Inter-American system of human rights protection. In this book, Mariana Monteiro de Matos analyzes, in detailed and comprehensive inquiry, the pertinent jurisprudence of the Inter-American Commission and Court of Human Rights. She identifies three distinct waves of decision regarding the objects of ownership or possession, the rights associated, and the holders of the rights. Originally, the book also offers a profound analysis of corollary procedural law.

Its use in evolutionary studies has resulted in an explosion of knowledge which has never before been gathered into a single volume. This book spans the full range of evolutionary studies - population genetics, ecology, ecological genetics, speciation, phylogenetics, genome evolution, molecular; evolution, and development. In covering these topics, highlights of empirical research are emphasized and are put into the context of major issues in evolution.

Human Rights in Translation

Human Rights in Translation

Autor: Michal Jan Rozbicki

Número de Páginas: 253

This volume reflects on what happens when the idea and practice of universal human rights cross the cultural borders between different communities of knowledge. Although such rights are usually presumed to be founded on certain globally shared beliefs, the norms and values of many cultures are often incommensurable with these "universal" principles, and hence the need to translate and “vernacularize” them. Any law that would successfully institutionalize them must frame human rights in a way that defers to the historically constituted cultural capital of the society in which it is to function. The essays in this book seek to illuminate different cognitive contexts that produce different meanings of rights, identify spaces of intercultural crossings where differences can coexist, and offer usable narratives and metaphors that could help mediate between distinct cultures. They show that the path forward does not lead through a unified theory of human rights that can be applied globally, nor through mere repackaging of rights in a more understandable language. What is needed is a deep understanding of the process of intercultural dialogue, the cultural "grammar" involved in...
