Angler

Angler

Autor: Barton Gellman

Número de Páginas: 508

The landmark exposé of the most powerful and secretive vice president in American history Barton Gellman shared the Pulitzer Prize in 2008 for a keen-edged reckoning with Dick Cheney's domestic agenda in The Washington Post. In Angler, Gellman goes far beyond that series to take on the full scope of Cheney's work and its consequences, including his hidden role in the Bush administration's most fateful choices in war: shifting focus from al Qaeda to Iraq, unleashing the National Security Agency to spy at home, and promoting cruel and inhumane methods of interrogation. Packed with fresh insights and untold stories, Gellman parts the curtains of secrecy to show how the vice president operated and what he wrought. An inspiration for the film Vice, starring Christian Bale, Amy Adams, and Steve Carrell.

I Will Never See the World Again

I Will Never See the World Again

Autor: Ahmet Altan

Número de Páginas: 225

Best Book of the Year – Bloomberg News A resilient Turkish writer’s inspiring account of his imprisonment that provides crucial insight into political censorship amidst the global rise of authoritarianism. The destiny I put down in my novel has become mine. I am now under arrest like the hero I created years ago. I await the decision that will determine my future, just as he awaited his. I am unaware of my destiny, which has perhaps already been decided, just as he was unaware of his. I suffer the pathetic torment of profound helplessness, just as he did. Like a cursed oracle, I foresaw my future years ago not knowing that it was my own. Confined in a cell four meters long, imprisoned on absurd, Kafkaesque charges, novelist Ahmet Altan is one of many writers persecuted by Recep Tayyip Erdoğan’s oppressive regime. In this extraordinary memoir, written from his prison cell, Altan reflects upon his sentence, on a life whittled down to a courtyard covered by bars, and on the hope and solace a writer’s mind can provide, even in the darkest places.

El saqueo de la imaginación

El saqueo de la imaginación

Autor: Irene Lozano

Autor: Laura Alzola Kirschgens

On the Rule of Law

On the Rule of Law

Autor: Brian Z. Tamanaha

Número de Páginas: 196

The rule of law is the most important political ideal today, yet there is much confusion about what it means and how it works. This 2004 book explores the history, politics, and theory surrounding the rule of law ideal, beginning with classical Greek and Roman ideas, elaborating on medieval contributions to the rule of law, and articulating the role played by the rule of law in liberal theory and liberal political systems. The author outlines the concerns of Western conservatives about the decline of the rule of law and suggests reasons why the radical Left have promoted this decline. Two basic theoretical streams of the rule of law are then presented, with an examination of the strengths and weaknesses of each. The book examines the rule of law on a global level, and concludes by answering the question of whether the rule of law is a universal human good.

The Precautionary Principle in the Law of the Sea

The Precautionary Principle in the Law of the Sea

Autor: Simon Marr

Número de Páginas: 267

The content and status of the precautionary principle remains highly debated and various questions arise, such as its status as a rule of customary international law, including its scope, addressee, triggering threshold, precautionary action measures, and eventually limits of the principle. Thus, this book examines the present state of affairs regarding the implementation of the principle in the law of the sea in different sectors, e.g. pollution of the marine environment, conservation and management of living marine resources, and transboundary transports of radioactive and hazardous wastes. In addition, it extracts evidence of its acceptance as part of customary international law, and indicates that below this level there is also an emerging practice of international law of applying the precautionary principle in a common way.

The Falklands Saga

The Falklands Saga

Autor: Graham Pascoe

Número de Páginas: 861

The Falklands Saga presents abundant evidence from hundreds of pages of documents in archives and libraries in Buenos Aires, La Plata, Montevideo, London, Cambridge, Stanley, Paris, Munich and Washington DC, some never printed before, many printed here for the first time, in English and, where different, in their original languages, Spanish, French, German, Italian, Latin or Dutch. It provides the facts to correct the fallacies and distortions in accounts by earlier authors. It reveals persuasive evidence that the Falklands were discovered by a Portuguese expedition at the latest around 1518-19, and not by Vespucci or Magellan. It demonstrates conclusively that the Anglo-Spanish agreement of 1771 did not contain a reservation of Spanish rights, that Britain did not make a secret promise to abandon the islands, and that the Nootka Sound Convention of 1790 did not restrict Britain's rights in the Falklands, but greatly extended them at the expense of Spain. For the first time ever, the despairing letters from the Falklands written in German in 1824 to Louis Vernet by his brother Emilio are printed here in full, in both the original German and in English translation, revealing the...

Keeping the Peace

Keeping the Peace

Autor: Nigel D. White

Número de Páginas: 314

This new edition considers the unifying legal attributes that span vastly differing inter-governmental organisations, from the UN to the EU. A law of international organisations has become established in certain areas, such as legal personality, powers, membership, finance, and decision-making. In other, newer, areas - accountability, responsibility and democracy - politics is still much rawer, and has not yet been fully converted into legal concepts and principles. As with the first edition, there are plenty of examples of organisations given in the text. Individual organisations dealing with issues such as security, health, civil aviation, finance and trade are scrutinised by way of example, to illustrate how different they can be, but also to show how it is possible to debate a set of legal principles that transcend each institution. This new edition of an established text will appeal to students and academics as well as individuals seeking a legal and political insight into international organisations.

Simplex Society

Simplex Society

Autor: Koen Stroeken

Número de Páginas: 321

This open access book provides thought-provoking anthropology grounded in comparative ethnography. The theory captures the current historical moment, the long-term trends that led us here, and the prospects for a humane future. The experience of complexity characterizing a globalized information society triggers simplexes. These unidimensional responses instrumental in bringing about a predictable effect are altering our ways of communicating and the technologies we design. In Part I, a ‘speciated’ history, injected with the anthropology of Bateson and Gluckman, describes the semantic and experiential impoverishment of the lifeworld. After going through the affects of distrust (the neolithic lifeway), of futility (industrial lifeway) and disconnection (post-knowledge), the human species today depends for its survival on installing a new lifeway, which manages to wed (eco-social) inclusion to the already difficult first pair of the French Revolution. The species needs to rehumanize. Part II illustrates the remedies currently developed: to reframe, re-sphere and re-source. What do critical street art, international football matches, presidential elections, hip-hop dissing...

Número de Páginas: 289

China's Influence on Non-Trade Concerns in International Economic Law

China's Influence on Non-Trade Concerns in International Economic Law

Autor: Paolo Farah , Elena Cima

Número de Páginas: 585

This volume examines the range of Non-Trade Concerns (NTCs) that may conflict with international economic rules and proposes ways to protect them within international law and international economic law. Globalization without local concerns can endanger relevant issues such as good governance, human rights, right to water, right to food, social, economic, cultural and environmental rights, labor rights, access to knowledge, public health, social welfare, consumer interests and animal welfare, climate change, energy, environmental protection and sustainable development, product safety, food safety and security. Focusing on China, the book shows the current trends of Chinese law and policy towards international standards. The authors argue that China can play a leading role in this context: not only has China adopted several reforms and new regulations to address NTCs; but it has started to play a very relevant role in international negotiations on NTCs such as climate change, energy, and culture, among others. While China is still considered a developing country, in particular from the NTCs’ point of view, it promises to be a key actor in international law in general and, more...

A ‘Stepped Approach’ to Disputes on International Watercourses

A ‘Stepped Approach’ to Disputes on International Watercourses

Autor: Riley T. Denoon

Número de Páginas: 310

With increasing global pressure on scarce international water resources, the importance of dispute avoidance and resolution at the international level cannot be understated. A 'Stepped Approach' to Disputes on International Watercourses explores a conceptual and practical framework for addressing these complex challenges, presenting a structured, multi-faceted approach that integrates technical expertise, diplomatic negotiations, and, when necessary, binding adjudication. Drawing on a broad analysis of 225 international watercourse agreements, it puts forward a ‘stepped approach’ as an important tool that can foster cooperation, prevent conflicts, and ensure the equitable and sustainable use of our shared water resources.

International Law and the Environment

International Law and the Environment

Autor: Tuomas Kuokkanen

Número de Páginas: 447

This important book makes an original and modern contribution to the study of "international environmental law", addressing its development over three time periods: the traditional period, the modern era, and the post-modern period. Kuokkanen's thesis is this: in the traditional period there was no clear distinction between the protection of the environment and the exploitation of natural resources; during the modern period the subjects became completely separated; and in the post-modern era there has been an effort to reconcile economic interests and environmental concerns. The work challenges the reader to think about international environmental law and its development within a broader framework, and through a lens which differs from that taken elsewhere. The book presents an impressive panorama of the principal international legal developments over the past century in this area, and successfully pinpoints the tensions between environmental and economic objects over the past century. A timely and important contribution.

Shocked and Awed

Shocked and Awed

Autor: Fred Halliday

Número de Páginas: 298

Far more than just a military conflict, the 'War on Terror' has been a struggle over values and meanings, a desperate contest for hearts and minds in which language has become the battlefield. In this highly original book, Fred Halliday takes us on a tour of this new war-zone, its artillery and trenches, minefields and booby-traps. Drawing on years of painstaking collation, Halliday shows how the 'War on Terror' has brought us not just new words, such as 'Gitmo', and new imports, such as 'jihad', but also new ways of using existing language, such as 'extraordinary rendition'. Scanning the pock-marked semantic landscape of the post 9/11 world, he uncovers hidden twists of phrasing and word associations, which in themselves tell a story about the violent clash of ideologies that has marked the opening of the 21st century. Part indispensable reference, part polemic, part entertaining snapshot of our times, "Shocked and Awed" is a bristling arsenal of the 21st century's most potent weapons: words.

The Constitution in Crisis

The Constitution in Crisis

Autor: House Democratic Judiciary Committee Staff

Número de Páginas: 519

The Republican-led Congress has been notoriously slow to investigate the current Republican administration. For that reason, Representative Conyers of Michigan commissioned his staff to put together the report that became The Constitution in Crisis. It chronicles the deceptions, manipulations, and retributions of President George W. Bush and his administration. Did the President mislead the country in order to invade Iraq? Have suspected “evil-doers” been tortured in violation of U.S. and international laws? Has the National Security Agency eaves-dropped on American citizens in violation of wire tapping laws? This report is a must-read for anyone concerned about the direction of our nation! Skyhorse Publishing, as well as our Arcade imprint, are proud to publish a broad range of books for readers interested in history--books about World War II, the Third Reich, Hitler and his henchmen, the JFK assassination, conspiracies, the American Civil War, the American Revolution, gladiators, Vikings, ancient Rome, medieval times, the old West, and much more. While not every title we publish becomes a New York Times bestseller or a national bestseller, we are committed to books on...

Ethics and Investor-State Dispute Settlement

Ethics and Investor-State Dispute Settlement

Número de Páginas: 204

Can a person simultaneously act as counsel and arbitrator? Can an arbitrator have too many appointments? Will artificial intelligence write awards? In this book, we seek to provide an in-depth analysis of key ethics issues that have arisen in the process of reforming investor-state dispute settlement in Working Group III of the United Nations Commission of International Trade Law (UNCITRAL). This comprehensive study of ethical requirements is written by leading experts in the field and discusses key issues, including the UNCITRAL Codes of Conduct, double-hatting, issue conflicts, and many others. The book fills a gap in the literature and offers both practitioners and academics the necessary tools to navigate the complex landscape of ethical considerations in investment dispute settlement.

Intellectual Property Rights and Climate Change

Intellectual Property Rights and Climate Change

Autor: Wei Zhuang

Número de Páginas: 469

As the world confronts global warming, there is a growing consensus that the TRIPS Agreement could be a more effective instrument for mitigating climate change. In this innovative work, Wei Zhuang systematically examines the contextual elements that can be used in the interpretation of the TRIPS Agreement with a view to enhancing innovation and transfer of environmentally sound technologies. Zhuang proposes a balanced and pro-competitive interpretation that could be pursued by policymakers and negotiators. This comprehensive, multidisciplinary study will help academics and policymakers improve their understanding of the contemporary international legal regimes governing intellectual property rights, as well as innovation and transfer of environmentally sound technologies. It also offers practical guidance for further developing a legal system capable of responding to the challenges posed by climate change.

Climate Change Law, Technology Transfer and Sustainable Development

Climate Change Law, Technology Transfer and Sustainable Development

Autor: Md Mahatab Uddin

Número de Páginas: 186

This book explores the possibilities and scope of facilitating innovation and transfer of the environmentally sound technologies in the Post-Paris climate era. The possibilities to be explored by the book will first focus on the roles of the climate finance and technological cooperation mechanisms in innovation and transfer of environmentally sound technologies. Secondly, the book will focus on role of the ‘flexible mechanism’ (i.e. indirect financial mechanisms), which has been re-introduced by the Paris Agreement as ‘voluntary cooperation’ or ‘sustainable development’ mechanism in innovation and transfer of environmentally sound technologies. Thirdly, the book will contain a comparative analysis regarding efficiency of the technology transfer mechanism under global climate regime in comparison with technology transfer mechanism that exists under other multilateral environmental agreements (MEAs). In addition to the above, since the issues of trans-boundary technology transfer is also a matter of concern for international trade, the book will discuss to what extent the international trade related laws e.g. intellectual property laws, investment related laws governed...

Quotas in International Environmental Agreements

Quotas in International Environmental Agreements

Autor: Amanda Wolf

Número de Páginas: 253

Quotas have been used in international environmental agreements for at least a century and, in tandem with incentive approaches, should continue to be crucial to realizing a sustainable environment. This text is a critical examination of quotas both as regulatory tools and as products of negotiation. It reviews the main features of environmental problems, the regulatory options and criteria used to judge them, and the various ways of explaining negotiated outcomes. Quotas in the management of fisheries, other resources, freshwater and marine pollution, and air pollution are also described. Selected examples are considered in detail to provide an understanding of how quotas were developed in scientific, political, economic and social context. An assessment of the key features of quotas in practice leads to the identification of an emerging approach, the negotiation of constrained local quotas. The approach is a practical way to balance efficiency and fairness in complex negotiations, without sacrificing environmental effectiveness.

The Interpretation of Investment Treaties

The Interpretation of Investment Treaties

Autor: Trinh Hai Yen

Número de Páginas: 408

Within the context of an exponential proliferation of investment treaties with virtually uniform language and structure, The Interpretation of Investment Treaties by Trinh Hai Yen reveals the neglect or misapplication of international rules on treaty interpretation by tribunals in arbitral cases. Such practice has raised the question of the legitimacy of the interpretative process and the engendered inconsistent interpretations of investment treaties. The book proposes three interpretative approaches aimed at ensuring that adjudicators find legitimate meaning in the challenging generality and vagueness of investment treaty language. It also provides a comprehensive analysis of legislative solutions for states through a case study of the ASEAN Comprehensive Investment Agreement, as well as a comparative analysis of modern and traditional investment treaties.

A Private Spy

Autor: John Le Carré

Número de Páginas: 557

John le Carré was a defining writer of his time. This enthralling collection letters - written to readers, publishers, film-makers and actors, politicians and public figures - reveals the playfully intelligent and unfailingly eloquent man behind the penname. _____ 'The symbiosis of author and editor, father and son, has resulted in a brilliant book, le Carré's final masterpiece' 5*, Jake Kerridge, Sunday Telegraph _____ A Private Spy spans seven decades and chronicles not only le Carré's own life but the turbulent times to which he was witness. Beginning with his 1940s childhood, it includes accounts of his National Service and his time at Oxford, and his days teaching the 'chinless, pointy-nosed gooseberry-eyed British lords' at Eton. It describes his entry into MI5 and the rise of the Iron Curtain, and the flowering of his career as a novelist in reaction to the building of the Berlin Wall. Through his letters we travel with him from the Second World War period to the immediate moment in which we live. We find le Carré writing to Sir Alec Guinness to persuade him to take on the role of George Smiley, and later arguing the immorality of the War on Terror with the chief of the ...

Sustainable Development Law

Sustainable Development Law

Autor: Marie-claire Cordonier Segger , Damilola S. Olawuyi

Número de Páginas: 785

Hundreds of new bilateral, regional, and global treaties have been negotiated in relation to the world's most pressing sustainability, development, and justice challenges over the past two decades. The majority of these face significant implementation challenges. At the same time, disputes over human rights, environmental protection, and economic development are increasingly common. Sustainable Development Law analyses these advances and challenges in the international law on sustainable development at the intersection between international social, environmental, and economic law. It opens by examining the origins of the concept of sustainable development, identifying and discussing the foundations of its legal aspects. The principles of international law related to sustainable development are considered, based on international instruments and disputes across international courts and tribunals. Later chapters provide illustrative examples of legal instruments and regimes that address the 169 targets in relation to the 17 Global Sustainable Development Goals. Finally, the authors propose cutting-edge research agendas and conclude by exploring the limits of sustainable development....

The Disputed Białowieża Forest

The Disputed Białowieża Forest

Autor: Maciej Perkowski , Wojciech Zoń , Przemysław Saganek

Número de Páginas: 264

The Polish dispute on an adequate approach towards the Białowieża Forest has been significantly internationalised, primarily by UNESCO and the European Union. The judgment of the CJEU has not settled the substance of the dispute, although it points to a violation of EU legal standards. The authors of The Disputed Białowieża Forest: Legal Remedies for the Protection of Cross-border Properties address the dispute in a constructive and interdisciplinary manner, rather than merely expressing concern towards in situ conservation, and derive universal legal remedies from it. They conclude that in the case of unique invaluable goods, adequate individual solutions should be applied in the form of a localised agreement, open to many entities (interested states, international organisations and even socially responsible private corporations), on the condition that organisational and financial co-responsibility are accepted.
