Corporate Criminal Liability

Corporate Criminal Liability

Autor: Mark Pieth , Radha Ivory

Número de Páginas: 396

With industrialization and globalization, corporations acquired the capacity to influence social life for good or for ill. Yet, corporations are not traditional objects of criminal law. Justified by notions of personal moral guilt, criminal norms have been judged inapplicable to fictional persons, who ‘think’ and ‘act’ through human beings. The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders. It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.

The Actors of Collective Bargaining

The Actors of Collective Bargaining

Autor: Eduardo J. Ameglio

Número de Páginas: 366

No one denies that the institution of collective bargaining between workers and employers has been a powerful tool for social dialogue. Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry....

1st World Conference on Biomass for Energy and Industry

Autor: Spyros Kyritsis

Número de Páginas: 1170

The 1st World Conference and Technology Exhibition on Biomass for Energy and Industry, held in Sevilla in June 2000, brought together for the first time the traditional European Conference on Biomass for Energy and Industry and the Biomass Conference of the Americas, thus creating the largest and most outstanding event in the worldwide biomass sector. The conference elaborated innovative global strategies, projects and efficient practice rules for energy and the environment at a key stage in the industry's development. New concepts and projects were highlighted to increase the social and political awareness for a change in worldwide resource consumption and to promote economically, socially and environmentally sustainable development for the next millennium. In 2 volumes, the Proceedings include some 470 papers essential to an understanding of current thinking, practice, research and global developments in the biomass sector - a vital reference source for researchers, manufacturers, and policy makers involved or interested in the use of biomass for energy and industry.

Criminal law between war and peace

Criminal law between war and peace

Autor: Stefano Manacorda , Adán Nieto Martín

Número de Páginas: 820

If subjecting war to law is one of the most important legal achievements of the 20th century, progressing further in that direction is one of the most important challenges for the 21st century. The problems it poses are many: the term “war” has formally fallen into disuse and we talk about “peacekeeping”; armies are today the product of cooperation between states and international organizations; private contractors increasingly participate in warlike activities, as the case of the Iraq war demonstrates; and the lines between war and very serious forms of crime (terrorism, organized crime) are increasingly blurred. This volume compiles the contributions presented at XVth International Congress on Social Defence, and tackle the criminal-legal issues raised by these new scenarios. It constitutes an innovative volume, gathering together the work of both academic and military authors, who have drawn on their theoretical and practical experience.
